The Board - Customer Loyalty Program - Terms & Conditions

J.Hilburn is proud to announce the inception of its Customer Loyalty Program (the “Program”). The Program is one way in which J.Hilburn endeavors to reward and thank you, its loyal customers, for patronizing our business, working with our extraordinary Stylists and purchasing our premium products. We recognize the unique and amazing relationships our customers share with their Stylists and with our merchandise. The Program intends to celebrate and fortify such relationships by rewarding our most loyal customer with discounted offerings and VIP access to our most amazing product lines. Please review the terms and conditions of the Program set forth below for more information about how the Program works and its reward structure. Feel free to contact your Stylist or the corporate offices at J.Hilburn with any questions or comments regarding the Program. Thank you for your loyalty!

BY PARTICIPATING IN THIS CUSTOMER LOYALTY PROGRAM, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS DESCRIBED HEREIN AND ALL TERMS INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO ALL OF THESE TERMS AND CONDITIONS, PLEASE ADVISE YOUR STYLIST THAT YOU DO NOT WISH TO PARTICIPATE IN THIS PROGRAM

A. General

1. These Terms and Conditions (“Terms and Conditions”) apply to your access to, and participation in, the J.Hilburn Customer Loyalty Program (the “Program”) which is operated by J.Hilburn, Inc., (“J.Hilburn”). These Terms and Conditions do not alter in any way the terms or conditions of any other agreement you may have with J.Hilburn for products, services or otherwise. J.Hilburn reserves the right to change, modify and/or eliminate the Program and/or these Terms and Conditions or any policy, or guideline pertaining to the Program at any time and in its sole discretion. Any changes or modifications will be effective immediately upon posting the revisions to www.jhilburn.com or by written or email notification to the participants in the Program. You hereby waive any right you may have to receive specific notice of such changes or modifications. Your participation in the Program confirms your acceptance of these Terms and Conditions and any such changes or modifications; therefore, you should review these Terms and Conditions and applicable policies frequently to understand the terms and conditions that apply to the Program. If you do not agree to the Terms and Conditions, you must advise your Stylist that you would like to stop participating in the Program.

2. Subject to Section C.6 of these Terms and Conditions, participants in the Program are eligible to receive loyalty rewards (the “Rewards”) based on their Lifetime Spend with J.Hilburn, as adjusted in accordance with these Terms and Conditions. “Lifetime Spend” will include all payments received for purchases made during the Program Period on a particular customer account, less, any payments made for taxes or shipping costs, less the purchase price of any returned products to the extent there any accepted returns of merchandise. The “Program Period” shall commence on the date a participant registers to participate in the Program, or earlier in accordance with Section A.3, and shall extend through the termination of the Program. For the purpose of clarification, Lifetime Spend will be calculated independently for each customer account, regardless of whether one customer is the responsible party for payment of merchandise on another customer account.

3. Commencing with November 2 2015, customers will be afforded the opportunity to register for the Program at www.jhilburn.com. The Program Period for participants who properly register for the Program prior to 11:59 PM Central Standard Time on December 2, 2015 (the “Early Registration Date”), shall begin on January 1, 2015 and such participants shall receive Lifetime Spend credit for all of their purchases dating back to such date. The Program Period for participants who register for the Program after the Early Registration Date shall commence on the date such registration occurs and such participants shall receive Lifetime Spend credit only for purchases made from such date and onwards.

4. The available Rewards for each participant of the Program will depend on which of the three tiers of Lifetime Spend such participant has reached (the “Tiers”). Tier status will be awarded/adjusted following the close of the prior fiscal month.

5. For the avoidance of doubt, except as set forth in this Section A.5., in no event shall the Lifetime Spend include purchases made prior to January 1, 2015. Notwithstanding the forgoing, J.Hilburn may, in its sole discretion, grant a participant Tier status at the initiation of the Program, or otherwise, based upon purchases made prior to January 1, 2015.

6. Customers who fail to provide their customer information to J.Hilburn, its Stylists or agents when purchasing J.Hilburn’s products or utilizing J.Hilburn’s services, will not receive Lifetime Spend credit for such purchases.

7. This program is not targeted towards, nor intended for use by, anyone under the age of 13. If you are between the ages of 13 and 18, you may only use the Program under the supervision of a parent or legal guardian who agrees to be bound by these Terms and Conditions.

B. The Rewards

1. Currently, there are three (3) Tiers which offer the following Rewards:

Trustee $25,000 The Patron and Benefactor Tier Rewards plus unlimited complimentary Suiting Options.

2. The Rewards are all “stackable,” meaning that a participant who achieves Trustee status will be eligible to utilize the Rewards he received for reaching Patron Status and Benefactor status as well.

3. “The Shirting Options” for the Benefactor Tier and Trustee Tier Members and the “The Suiting Options” for the Trustee Tier Members are described below:

Suiting (Jacket) Options

  • Working Button Holes
  • Half-Lined

Suiting (Trouser) Options

  • Distressed Buttons
  • Shell Buttons

4. Only the Shirting Options and Suiting Options listed above will be eligible for complimentary Rewards under the Program. Any other shirting or suiting options offered by J.Hilburn but not specifically listed above will not be eligible as a complimentary Reward under the Program at this time.

5. Once you reach a specific Tier within the Program, you will receive the benefits that are applicable to such Tier at that time. However, in order for participants to maintain their Tier status, participants must spend a minimum of $500.00 in a calendar year (January 1- December 31). Participants who fail to meet such minimum spend threshold will lose their Tier status but can regain their status once they spend at least $500.00 in a calendar year.

6. Rewards may only be utilized on a going-forward basis, and may not be used to adjust prices on any previously made purchases.

C. Miscellaneous

1. There are no membership fees associated with the Program. Rewards accumulated under the program are promotional and have no cash value and are non-refundable.

2. Your Lifetime Spend, Rewards, and your account under the Program are personal to you and may not be sold, transferred or assigned to, shared with family, friends or others or bartered (including but not limited to transferring, gifting, or promising mileage credit or award tickets in exchange for support of a certain business, product or charity and/or participation in an auction, sweepstakes, raffle or contest). Any violation of this Section will cause such Rewards to be void.

3. Fraud, misrepresentation, abuse or violation of applicable rules is subject to administrative and/or legal action by appropriate governmental authorities and J.Hilburn.

4. J.Hilburn reserves the right to terminate your account and/or your participation in the Program if J.Hilburn determines in its sole discretion that you have violated these Terms and Conditions or that the use of your account is unauthorized, deceptive, fraudulent or otherwise unlawful. J.Hilburn may, in its sole discretion, suspend, cancel or combine accounts that appear to be duplicative.

5. J.Hilburn reserves the right to audit any and all accounts at any time and without notice to the member to ensure compliance with program rules and applicable conditions.

6. J.Hilburn reserves the right to terminate, discontinue, modify or cancel the Program at any time and in its sole discretion without notice to you. J.Hilburn reserves the right to modify these Terms and Conditions with respect to any particular participant, in its own discretion.

7. J.Hilburn and its Stylists or agents are in no way obligated to make any customer aware of the Program or the registration process for the Program. J.Hilburn shall have no obligation to provide a customer access to register for the Program and in no way shall be obligated to extend a customer’s Program Period based on such customer not being able to register, including prior to the Early Termination Date, whether due to the inaccessibility of the online registration portal or otherwise.

8. Please read the Privacy Policy carefully to understand how J.Hilburn collects, uses and discloses information about customers and how to update or change your personal information and how we communicate with you.

9. These Terms and Conditions are governed by and to be interpreted in accordance with the laws of the State of Texas. To the full extent allowed by law, these Terms and Conditions disclaim any duty of good faith and fair dealing as well as any implied contractual terms or obligations.
